According to the Fort Oglethorpe Police Department:
Andrew Paul Hayes, 29, of Second Street in Rossville was arrested on Sunday, Feb. 5, on a charge of DUI. He has since been released from jail on bond.
Officers were dispatched to K-Mart at 526 Ga. 2 (Battlefield Parkway) at approximately 5:30 p.m. on Feb. 5 after a store employee called police in reference to an intoxicated man shopping in the store with three kids.
“Upon my arrival, I made contact with the offender, whom I observed to be very unsteady on his feet and smell-ing of alcohol,” officer Jeff Holcomb wrote in the report. “The offender (Hayes) admitted that he had been drinking and that he had also taken methadone earlier.”
During questioning, Hayes stated that his wife had driven him and the children to the location and dropped them off. However, after officers made contact with Hayes’ wife, she told police that he had driven himself there and that she had no knowledge that he was intoxicated. She also stated that she would be at the location as quickly as possible to pick up the children.
“Based on the information that I received from his wife, the offender then stated that he did indeed drive him-self to the incident location,” Holcomb said.
Hayes then failed a sobriety test administered by officer Holcomb, reports show.
“I had him perform a one-legged stand, which he failed by losing his balance, touching his foot to the ground, then falling backwards.” Holcomb said.
Hayes was then placed under arrest and transported to Catoosa County jail without incident.
Hayes’ children were turned over to his wife at the scene.
